It gets better….Evan also represents candidates in Rockland County. In fact, The Parkside Group (Evan in particular), was the paid consultant representing Louis Falco in the recent democratic primary for Rockland County Sheriff. As chairwoman of the Rockland Democratic Committee, Stavisky’s wife enjoyed a profit from the $80,000 Falco paid Parkside. She proclaimed “neutrality” in the primary, yet hubby was the paid consultant for Flco. Nice teamwork. Totally immoral.

I guess he likes to pay city taxes on his “FAT CAT” income which will go up when the Democ”RATS” repeal the Bush Tax cut and raise taxes on the “Wealth” like Evan, I guess they file Married but separate and I wonder how they split the expenses ?

I guess the “FAT CATS” like Evan can afford to pay NYC Taxes.

Election Law § 1-104(22) defines the term residence as the “place where a person maintains a fixed, permanent and principal home and to which he [or she], wherever temporarily located, always intends to return” (see People v. O’Hara, 96 N.Y.2d 378, 384). The Election Law, however, “does not preclude a person from having two residences and choosing one for election purposes provided [that] he or she has ‘legitimate, significant and continuing attachments’ to that residence” (Matter of Isabella v. Hotaling, 207 A.D.2d 648, 650, lv denied 84 N.Y.2d 801, quoting Matter of Ferguson v. McNab, 60 N.Y.2d 598, 600). The crucial factor in determining “whether a particular residence complies with the requirements of the Election Law is that the individual must manifest an intent, coupled with physical presence ‘without any aura of sham’ “ (O’Hara, 96 N.Y.2d at 385).

Evan has clearly taken care to be able to demonstrate manifest intent. The question presented is whether he has sufficient physical presence without an aura of sham. That said someone with standing would have to complain of same before a Queens Judge. Evan defended Carozza but attacked Koo and Ciafone – consistency being the hobgoblin of little minds.

Evan has a residence in Queens. NY State law allows a person to have two residence. Where he chooses to vote is his business and his right. Plus he does more for Queen then some elected leaders.
